Immigrants Sexually Abused at Georgia Detention Center and Other ICE Facilities Nationwide
Shedding light on alleged sexual abuse of ICE immigrant detainees at Stewart Detention Center in Lumpkin, Georgia as well as ICE facilities nationwide
For years, patterns of sexual abuse have plagued U.S. Immigration and Customs Enforcement (ICE) detention facilities nationwide. Recently, the civil rights attorneys at G&E, with co-counsel, filed a Freedom of Information Act (“FOIA”) complaint on behalf of a 28-year-old survivor of sexual assault by a nurse at Stewart Detention Center, an ICE facility in Georgia. The complaint seeks to retrieve records from ICE, the Department of Homeland Security (“DHS”), and various DHS agencies and hold those agencies liable for violating FOIA, a law that enables members of the public to request records from the government. Specifically, G&E seeks the production of records related to the survivor’s own immigration file, as well as records related to ICE’s investigation of reports of sexual abuse by the male nurse and records related to the management, oversight, and operations of Stewart Detention Center.
Immigrants seeking asylum in the U.S. are protected by the Prison Rape Elimination Act, or PREA. Depending on the circumstances, prisoners or their family members may be able to file lawsuits for rights violations, including sexual abuses. Survivors may suffer physical and psychological damage, leading to a severely reduced quality of life. Fortunately, survivors of sexual misconduct have rights that can help bring the perpetrators to justice. At G&E, we are here to listen to your story and potentially hold those responsible accountable for their actions.
