G&E Obtains Favorable Ruling in Wrongful Death and Disability Discrimination Case

In a recent decision, the United States District Court for the Middle District of Georgia held that Plaintiff’s claims for wrongful death and disability discrimination under the Rehabilitation Act can proceed. This follows a motion to dismiss by defendant CoreCivic, Inc., who operates the Stewart Detention Center in Georgia. The plaintiff filed the lawsuit in July 2018 on behalf of his son, Efrain Romero-Garcia, a Mexican immigrant who committed suicide while in U.S. Immigration and Customs Enforcement (“ICE”) custody at Stewart Detention Center. The complaint alleges that, despite knowledge of Efrain’s persistent mental illness, CoreCivic denied him medical care and repeatedly held Efrain in solitary confinement, which exacerbated Efrain’s mental illness and ultimately led to his suicide.
